Belek and Özkurt v. Turkey (no. 2), No. 28470/08, ECtHR (Second Section), 17 June 2014

Abstract

Freedom of expression and publications. Applications of the principle in the publication of an article reporting the declarations made by a terrorist organization.

Normative references

Art. 10 ECHR
Art. 6 ECHR

Ruling

The Court finds that there is a violation of art. 10 of the Convention (right to freedom of expression) in the conviction of the chief heads of a magazine, responsible for publishing an article reporting the declarations of a terrorist leader. In the present case, the Court does not find that there was any incitement to violence or hate speech within the declarations, which are therefore publishable.
