Religious Care in Prison: Systemic Issues and Regulatory Asymmetries

The Italian penitentiary system formally guarantees prisoners’ freedom of religion but, in practice, reveals significant asymmetries between the Catholic faith and other religious denominations, particularly with regard to clergy access and the role of state agreements and administrative practices.

Door to door preaching is protected by Art. 9 ECHR 
The Court of Cassation rejected the appeal of a taxpayer who had paid part of their declared IRPEF to charitable organisations and the National Office for Civil Service, in support of nonviolent defence and financial assistance for high-risk pregnancies rather than abortion. The Court rejected the appeal on the grounds that such conduct is incompatible with the fundamental duties of social solidarity.

A State violates the rights to freedom of religion, peaceful enjoyment of possessions, and non-discrimination where, without an objective and reasonable justification, it prevents a duly registered religious community for a prolonged period from concluding the agreement provided for under domestic law, thereby denying it access to a public funding scheme designed to support the effective exercise of religious freedom.
