Ruling

The Court finds that there is a violation of art. 10 of the Convention (right to freedom of expression) in the conviction of the chief heads of a magazine, responsible for publishing an article containing the declarations of an illegal armed organization. In the present case, there is a violation because the declarations are not deemed to incite violence but rather relate to the conditions of detention of the leader of PKK and comprise of requests of ameliorating such conditions.
