Ruling
1. The right to free elections and freedom of expression constitute the foundation of any democratic society. The two rights are interconnected and operate in tandem. For this reason, it is particularly important that in the period leading up to elections, opinions and information of all kinds can circulate freely.
2. The fact that Russian law provides for a limitation of freedom of the press and information during the election period and that the application of these limitations are exercised in a generic manner constitutes a violation of Article 10 ECHR and Article 3 Protocol 1 ECHR.
(During the 2007 general elections, the Orlovskaya Iskra newspaper was condemned for publishing propaganda material without these being paid for from the official campaign fund by any party).
