The exclusion of same-sex couples as potential foster families for children is not discriminatory, since the religious freedom of the Catholic body entrusted with the management of the placement of children with foster families must prevail. By requiring the organization to choose between restricting the scope of the mission it pursues or accepting parental relationships that conflict with its convictions, the administration would place an excessive burden on the exercise of the organization’s religious freedom.
