Ruling
1. The post-election phases including the counting, registration and transfer of election results are an indispensable part of the electoral process. As such, they should be carried out with clear procedural safeguards, be open and transparent.
2. The right to an effective remedy against decisions of the electoral authorities is among the rights guaranteed by Art. 3 Prot. 1 ECHR.
(The applicants alleged that the Electoral Commission had falsified the election results by ordering a recount of votes in which more votes were systematically awarded to the ruling party and its candidates, while opposition parties and candidates were deprived of votes).
